Terms & Conditions

These Terms and Conditions (“Terms”) govern your access to and use of SubwaySync (the “Service”), operated by an individual based in New York City (“we”, “our”, “us”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. User Accounts
- Google Sign-In is required to use the Service.
- You are responsible for maintaining the security of your account and all activity that occurs under it.
- You must immediately notify us of any unauthorized use of your account.
- You may delete your account at any time through the Service.
2. Acceptable Use
You agree not to:
- Use the Service for unlawful purposes.
- Reverse engineer, scrape, or interfere with the Service.
- Abuse, overload, or attempt to bypass system limitations.
- Exploit the Service to send spam or bulk automated requests to any of our Third-Party Services.
- Use the Service in a way that violates Third-Party Services terms.
- We reserve the right to suspend or terminate access for violations.
3. Third-Party Services
The Service depends on third-party platforms and infrastructure, including but not limited to:
- Google: We are not affiliated with Google. Your use of Google Calendar is subject to Google’s Terms of Service.
- MTA: We are not affiliated with, endorsed by, or connected to the Metropolitan Transportation Authority. "MTA" is a trademark of the Metropolitan Transportation Authority.
- Supabase: We use Supabase as a database and infrastructure provider to store and process data on our behalf.
- Render: Our application is hosted on the Render cloud platform.
We are not responsible for outages, changes, data loss, or service interruptions caused by third-party services.
4. Service Availability and Modifications
- The Service is provided on an “as is” and “as available” basis. We may modify, suspend, or discontinue any part of the Service at any time without liability.
- We do not guarantee uninterrupted or error-free operation.
5. Termination
- You may terminate your account at any time.
- We may suspend or terminate access at any time, with or without cause.
6. Intellectual Property
All software, branding, and content associated with the Service are owned by us or our licensors. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service for personal, non-commercial purposes.
7. Disclaimer of Warranties
- The Service is provided without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, or reliability.
- Data is obtained from the MTA API and is redistributed through SubwaySync service.
- It is not guaranteed that the data is accurate, complete, or timely.
- Subway service information is informational only and should not be relied upon for time-sensitive, safety-critical, or emergency decisions.
8. Limitation of Liability
To the maximum extent permitted by law:
We shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, or goodwill).
- Any damages resulting from missed meetings, travel delays, or schedule disruptions caused by reliance on the app.
- Any unauthorized access to or use of our servers and/or any personal information stored therein.
- Our total liability shall not exceed the amount you paid us for the Service, or zero if no fees were paid.
9. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising out of your use of the Service or violation of these Terms.
10. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
11. Governing Law and Venue
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any legal action shall be brought exclusively in courts located in New York.
